AMUSTAY 利用規約
本利用規約（以下「本規約」）は、合同会社安藤志塾（以下「当社」）が提供する AMUSTAY のウェブサイト、Android アプリ、関連サービス（以下総称して「本サービス」）の利用条件を定めます。本サービスを利用することにより、本規約に同意したものとみなされます。
AMUSTAY は、宿泊施設、航空券、設備、アクセシビリティ、音楽・防音設備、長期滞在その他の旅行関連情報を検索・整理・共有するための情報サービスです。当社は、別途明示しない限り、ホテル、旅行会社、予約代理店、不動産仲介業者その他の取引当事者ではありません。
施設、設備、価格、空室、安全性、合法性、アクセシビリティ、騒音・防音性能その他の情報について、常に正確・最新・完全であることを保証しません。
ユーザーは、施設情報、写真、動画、リンク、設備情報、位置情報、評価、レビュー、コメント、報告、修正提案その他の情報（以下「ユーザーコンテンツ」）を投稿できる場合があります。ユーザーは、自らのユーザーコンテンツについて責任を負います。
虚偽、違法、権利侵害、名誉毀損、なりすまし、プライバシー侵害、秘密情報、マルウェア、スパムその他本サービスの安全・運営を害する内容を投稿してはなりません。
ユーザーは、ユーザーコンテンツについて自らが有する著作権その他の権利を保持します。ユーザーコンテンツを本サービスに送信、投稿または提供することにより、ユーザーは当社に対し、当該ユーザーコンテンツを、現在知られているまたは将来開発されるあらゆる媒体・配信方法において、使用、保存、複製、処理、翻案、編集、改変、公開、送信、表示、配布、翻訳、抜粋、要約、分類、索引化、検索可能化、組合せ、分析その他利用するための、世界的、非独占的、無償かつ再許諾可能な利用権を許諾します。
この利用許諾には、本サービスおよび関連サービスの提供、維持、改善、開発、保護、宣伝、検索・推薦、モデレーション、多言語化、自動処理、品質評価、データ分析その他の機能のためにユーザーコンテンツを利用する権利を含みます。
写真・動画その他の視覚コンテンツについては、表示最適化、プライバシー保護およびサービス運営のため、圧縮、サイズ変更、形式変換、トリミング、回転、色調等の技術的調整、サムネイル生成、ぼかし、マスキング、個人識別要素の除去その他の編集・加工を行うことがあります。
著作者人格権その他譲渡できない権利は、法令に従い権利者に留保されます。ユーザーは、適用法令上許される範囲で、本サービスの通常の運営に必要な表示、翻訳、要約、トリミング、サイズ変更、サムネイル生成、ぼかし、分類その他合理的な編集・加工について、当社および当社から適法に権利を得た者に対して著作者人格権を行使しないことに同意します。
ユーザーは、投稿するユーザーコンテンツについて、本規約に定める利用許諾を与えるために必要な権利、同意、許可または権限を有することを表明します。第三者が識別できる写真・動画、私有空間、著作物、商標その他第三者の権利が関係する素材を投稿する場合、必要な許可を得てください。
特に、第三者の顔、氏名、名札、車両番号、住所その他個人を識別し得る情報を不必要に投稿しないでください。当社は、これらを削除、ぼかし、トリミングその他の方法で処理することがあります。
当社は、ユーザーコンテンツから、施設の設備、段差、アクセシビリティ、楽器、防音設備、営業時間、位置、カテゴリ、タグ、評価傾向その他の事実情報・分類情報を抽出、整理、統合または要約することがあります。
法令上許される範囲で、個人との合理的な関連付けを除去した施設情報、統計情報、集約情報、要約、分類、タグ、スコア、サムネイルその他の派生データは、元のアカウントが削除された後も本サービスの情報資産として保持・利用される場合があります。
アカウント削除は、ユーザーに紐づく個人情報および認証情報の削除・匿名化を目的とするものであり、公開済みの施設情報その他すべての投稿を機械的に消去することを意味しません。
アカウント削除後、当社はプライバシーポリシーに従い、ユーザーとの関連付けを解除し、個人を識別できる情報を削除・ぼかし・匿名化する等の措置を行った上で、施設情報、レビューの要約、統計・集約情報、人物を識別できない施設写真・サムネイルその他のコンテンツを保持することがあります。
人物が主たる被写体である写真、投稿者本人を識別できる写真、個人情報を含む原本その他、合理的な加工によってもプライバシー上の問題を除去できないコンテンツは、原則として削除対象となります。ただし、法令、紛争対応、権利保護その他正当な理由がある場合を除きます。
本条に基づき適法に保持されるコンテンツおよび派生データについて、第3条の利用許諾はアカウント削除後も必要な範囲で存続します。
レビューや評価は、実際の経験または誠実な情報に基づくものとしてください。当社は、サービスの品質・安全性・法令遵守のため、投稿を確認、編集、要約、統合、非表示、削除、復元、分類、検証または拒否することがあります。
本サービスは、Google、Telegram、旅行検索・予約事業者、地図、決済その他の第三者サービスを利用またはそれらへのリンクを提供する場合があります。第三者サービスには各提供者の規約・プライバシーポリシーが適用されます。
一部の機能にはログインが必要です。ユーザーは、自身のアカウントおよび認証手段を適切に管理してください。当社は、不正利用、スパム、詐欺、権利侵害、本規約違反その他合理的な理由がある場合、アカウントまたは機能を制限、停止または終了できるものとします。
サービスへの攻撃、認証・技術的制限の回避、過度な自動取得、マルウェアの配布、不正アクセス、なりすまし、嫌がらせ、権利侵害、虚偽報告、削除・通報機能の悪用その他サービス運営を妨げる行為を禁止します。
本サービスは「現状有姿」かつ「提供可能な範囲」で提供されます。法令上許される最大限の範囲で、当社は、正確性、完全性、可用性、商品性、特定目的適合性、非侵害性、継続運用等について明示または黙示の保証を行いません。
法令上許される最大限の範囲で、当社は、本サービス、第三者サービス、旅行・予約判断、施設情報またはユーザーコンテンツの利用に関連して生じた間接損害、特別損害、結果損害その他の損害について責任を負いません。消費者契約法その他の強行法規により制限できない責任は、この限りではありません。
当社は、本サービスの機能を変更、追加または終了し、本規約を合理的な必要に応じて更新することがあります。重要な変更は、本サービス上その他適切な方法で告知します。
本規約は日本法に準拠します。法令上別段の定めがある場合を除き、本サービスに関する紛争については、当社の主たる事務所の所在地を管轄する日本の裁判所を第一審の管轄裁判所とします。

These Terms of Service (“Terms”) govern AMUSTAY websites, the Android application, and related services (collectively, the “Service”) provided by Ando Shijuku LLC (“we,” “us,” or “our”). By using the Service, you agree to these Terms.
AMUSTAY is an information service for searching, organizing and sharing information about accommodation, flights, facilities, accessibility, music/soundproofing features, long stays and related travel information. Unless expressly stated otherwise, we are not a hotel, travel agent, booking agent, real-estate broker or party to transactions between users and third parties.
We do not guarantee that facility, equipment, price, availability, safety, legality, accessibility, noise/soundproofing or other information is always accurate, current or complete.
You may be able to submit place information, photos, videos, links, facility details, location information, ratings, reviews, comments, reports, correction requests and other materials (“User Content”). You are responsible for your User Content.
You must not submit false, unlawful, infringing, defamatory, impersonating, privacy-invasive, confidential, malicious, spam or otherwise harmful content.
You retain the copyright and other rights you hold in your User Content. By submitting, posting or otherwise providing User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free and sublicensable license to use, host, store, copy, reproduce, process, adapt, edit, modify, publish, transmit, display, distribute, translate, excerpt, summarize, classify, index, make searchable, combine, analyze and otherwise use that User Content in any media or distribution method now known or later developed.
This license includes use for operating, maintaining, improving, developing, protecting and promoting the Service and related services, search and recommendations, moderation, localization, automated processing, quality evaluation, data analysis and other Service functions.
For photos, videos and other visual content, we may compress, resize, convert format, crop, rotate, technically adjust, generate thumbnails, blur, mask, redact identifiers or otherwise edit the content for display optimization, privacy protection and operation of the Service.
Moral rights and other non-transferable rights remain with the relevant rights holder as required by law. To the extent permitted by applicable law, you agree not to assert such rights against us or lawful sublicensees with respect to reasonable display, translation, summarization, cropping, resizing, thumbnail generation, blurring, classification and other editing or processing ordinarily necessary to operate the Service.
You represent that you have the rights, licenses, consents, permissions or authority necessary to submit your User Content and grant the license described in these Terms. If material includes identifiable third parties, private spaces, copyrighted works, trademarks or other third-party rights, obtain any permissions required by law.
Please avoid unnecessarily posting faces, names, name tags, vehicle numbers, addresses or other information that may identify third parties. We may remove, blur, crop or otherwise process such information.
We may extract, organize, combine and summarize factual or classificatory information from User Content, including facility features, steps, accessibility, instruments, soundproofing, opening hours, location, categories, tags and rating trends.
To the extent permitted by law, place information, statistics, aggregated information, summaries, classifications, tags, scores, thumbnails and other derived data that are no longer reasonably linked to an identifiable individual may be retained and used as Service information assets after the originating account is deleted.
Account deletion is intended to remove or de-identify personal and authentication data associated with the user. It does not necessarily require the mechanical deletion of every public contribution.
After account deletion, and in accordance with the Privacy Policy, we may unlink content from the account and remove, blur or otherwise de-identify identifying information while retaining place information, summarized reviews, statistical or aggregated information, non-identifying facility photos or thumbnails and other content.
Photos primarily depicting an identifiable person, photos identifying the account holder, originals containing personal information, and content whose privacy risk cannot reasonably be removed by processing will generally be deleted, except where retention is required or justified by law, dispute resolution, protection of rights or another legitimate reason.
The license in Section 3 continues after account deletion to the extent necessary for content and derived data lawfully retained under this Section.
Reviews and ratings should reflect genuine experiences or good-faith information. We may review, edit, summarize, merge, hide, remove, restore, classify, verify or reject content for quality, safety and legal compliance.
The Service may use or link to Google, Telegram, travel-search and booking providers, maps, payment providers and other third-party services. Their own terms and privacy policies apply to those services.
Some features may require sign-in. You are responsible for safeguarding your account and authentication methods. We may limit, suspend or terminate accounts or features where reasonably necessary because of abuse, spam, fraud, infringement, violation of these Terms or other legitimate reasons.
You must not attack the Service, bypass authentication or technical restrictions, scrape excessively, distribute malware, access systems without authorization, impersonate others, harass, infringe rights, submit false reports, abuse deletion/reporting features or otherwise interfere with Service operation.
The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation.
To the maximum extent permitted by law, we are not liable for indirect, special or consequential losses arising from the Service, third-party services, travel or booking decisions, place information or User Content. Nothing in these Terms excludes liability that cannot lawfully be excluded under mandatory law.
We may modify, add or discontinue Service features and update these Terms where reasonably necessary. Material changes will be communicated through the Service or another appropriate method.
These Terms are governed by the laws of Japan. Except where mandatory law provides otherwise, disputes relating to the Service will be submitted at first instance to the Japanese court having jurisdiction over the location of our principal office.
